Brocton inmate sentenced in attack on officer

An inmate at the Lakeview Shock Incarceration Correctional Facility will be spending more time behind bars.

District Attorney Jason Schmidt announced Thursday that Garry Pinkney, 25, of Bronx, NY, was sentenced by Judge David W. Foley to 1 and a half to 3 years in state prison after he was convicted of second-degree attempted assault, a class E felony.

While serving a state prison term on a 2018 conviction at the Brocton facility, Pinkney attacked and injured a correctional officer. This sentence is to be added to Pinkney’s current state prison term.

He was also sentenced as a predicate felon as this is Pinkney’s second felony conviction within 10 years.

Schmidt would like to thank the corrections officer and staff at Lakeview Correctional Facility for their assistance in prosecuting this case and the New York State Police for their work on the investigation. “An assault on any person is bad enough, but any attack on the men and women who serve our community and put themselves in harm’s way to protect the rest of us is terrible and egregious. I hope this conviction sends a message to the community that these types of crimes will not be tolerated in Chautauqua County,” he said.

This case was prosecuted by Assistant District Attorney Andrew Molitor.

The Associated Press reported in July of 2016 that Pinkey, who was 17 years old at the time, was arrested on charges of attempted rape, robbery, burglary and a criminal sex act.

According to the AP, Pinkey had followed a 13-year-old girl into an elevator in the Bronx, produced a knife and demanded money. When she refused, police said he removed items from her bag and forced her into a sex act and attempted to rape her.

The girl was treated at a hospital.
