Chautauqua County Sheriff’s Office

  • GERRY – Nicholas L. Rollins, 26, of Dunkirk was taken into custody on March 25 after deputies responded to a motor vehicle accident on Route 380 in the town of Gerry.

The operator of the vehicle was Rollins who, after an investigation, was charged with driving while ability impaired by drugs, third-degree aggravated unlicensed operation of a motor vehicle, and moving form a lane unsafely.

Rollins was arraigned in the Town of Charlotte Court and was remanded to the county jail in lieu of bail.

  • NORTH HARMONY – Matthew E. Hall, 47, of Ashville was stopped on Stoneledge Road in North Harmony on March 25, after officers observed him unsafely moving lanes. After a brief investigation, Hall was found to be allegedly intoxicated and was charged with driving while intoxicated, refusal of a pre-screen breath test, second-degree obstruction of governmental administration, and changing lanes unsafely.

Hall was arraigned in Chautauqua Court and remanded to the county jail in lieu of bail.

  • CHARLOTTE – Michael J. Seagrave, 27 of Sinclairville was observed sitting stopped in the driving lane on Charlotte Hill Road in Sinclairville on March 29. Seagrave identified himself after deputies contacted the vehicle and spoke to Seagrave, the operator. After being evaluated by a certified drug recognition expert, Seagrave was allegedly found to be operating the vehicle while being influenced by a combination of drugs and alcohol. Seagrave was also allegedly found to be in possession of a quantity of marijuana.

Seagrave was charged with driving while ability impaired by drugs and alcohol, unlawful possession of marijuana, and parking on the highway.

He was processed and released with citations directing him to appear in the Town of Charlotte Court at a later date.

  • MAYVILLE – Faith C. Jones, 40, of Fredonia, was served with appearance tickets to face charges related to welfare fraud on March 24.

Jones allegedly was working seasonally in 2014 and did not report that income to DHHS, and also failed to report an increase in income at her present employer.

As a result of the unreported income, Jones was receiving $710 in unentitled SNAP/food stamp benefits.

Jones was charged with two counts of first-degree offering a false instrument for filing, petit larceny, fifth-degree welfare fraud, and misuse of food stamps.

The arrest concludes a joint investigation by the Chautauqua County Sheriff’s Office and the DHHS Program Integrity Unit. Jones will appear in Jamestown City Court on April 21 for arraignment on the charges. Instances of suspected welfare fraud may be reported by calling the hotline, 1 (800) 388-5365.

STOW – Quentin Newhouse, 24, of Ashville was charged March 21 with felony driving while ability impaired, felony first-degree aggravated unlicensed operation and criminal possession of a hypodermic instrument after New York State Police and Chautauqua County Sheriff’s Office deputies responded to Old Bridge Road to check the welfare of a male subject who was reported unconscious in his vehicle at Hogan’s Hut.

State Police reportedly observed the suspect vehicle driving south on Old Bridge Road and initiated a traffic stop. The driver, Newhouse, performed roadside tests and was subsequently arrested for driving while ability impaired by drugs.

At the time of arrest, a used syringe was allegedly located on his person. Newhouse was transported to the State Police barracks in Jamestown where an evaluation was performed on him by a Drug Recognition Expert from the Chautauqua County Sheriff Department. A check of his driving record revealed multiple revocations and suspensions and s a conviction for aggravated driving while intoxicated in 2015.

As a result, the DWAI charge was upgraded to a felony in addition to the other charges. He is scheduled to appear in North Harmony Town Court.

CHERRY CREEK – John Thomas P. Irwin, 21, of Gowanda and Kyle N. Neubeck, 22, of North Collins were charged Sunday following a traffic stop on Main Street.

Deputies reportedly observed the subjects in possession of open containers of alcohol, in addition to various drug paraphernalia in plain view within the vehicle. Neubeck was reportedly found to be in possession of multiple Suboxone strips, and both men were found in possession of hypodermic needles.

Irwin was charged with criminally possessing a hypodermic instrument, possession of open container of alcohol in motor vehicle and fail to signal turn. Neubeck was charged with seventh-degree criminal possession of controlled substance, criminally possessing a hypodermic instrument and possession of open container of alcohol in a motor vehicle.

Both men were released with citations.

SINCLAIRVILLE – Aaron J. Restivo, 36, of Gerry was charged Saturday with fourth-degree criminal possession of a weapon, second-degree aggravated unlicensed operation and county court driving while intoxicated warrant after Deputies observed a vehicle being operated by Restivo.

Restivo was known to have an active County Court warrant. Restivo, who is convicted felon, was found to be in possession of a high-caliber rifle. A NYS driver’s license check revealed Restivo’s license was revoked for a prior DWI conviction. He was brought to Chautauqua County Jail and is being held without bail.

Gowanda Police

An unidentified subject, on March 1, was the subject of an EMS response call to a Gowanda address with reports of an unconscious, unresponsive victim of a drug overdose. Upon patrol’s arrival, the victim was ad-ministered two doses of Narcan with no results. Gowanda Ambulance Ser-vices arrived and administered a third dose, after which the victim became conscious and responsive. The victim was transported to Lake Shore Hospital.

Nathaniel P. Dubois II, 40, of Gowanda was taken into custody for speeding, DWI and first-degree aggravated unlicensed operation of a motor vehicle on March 1. Dubois was stopped by patrol on Buffalo Street for allegedly speeding; and appeared to be intoxicated and refused sobriety tests. During the traffic stop, the DMV computer check revealed that Dubois was driving with a license that had been suspended seven times from various courts for driving while impaired, and suspended a number of times since 2012 for failure to appear for traffic violations and failure to pay traffic fines. Dubois’ third-degree AUO was elevated to a felony due to his suspension for an alcohol-related offense and his arrest for DWI. According to reports, a breath chemical test revealed that Dubois’ BAC was .13. He was arraigned in the Collins Town Court and remanded to the Erie County Holding Center.

An unidentified subject, on March 4, was the subject of an EMS response call to a Gowanda address with reports of an unconscious, unresponsive victim of a drug overdose. Upon the patrol’s arrival it was found that a family member had already administered Narcan, and the victim had become conscious and responsive. The victim refused any assistance from patrol or EMS.

Eric K. Pierce, 32, of Gowanda, was released from Cattaraugus County Jail on March 7. The Cattaraugus County Sheriff’s Department was notified of Pierce’s release and a patrol was sent out to pick up Pierce, as a warrant was out for his arrest after he allegedly failed to appear in court for a charge of criminal mischief in 2015. He was arraigned in Persia Town Court and released on his own recognizance.

Reginald Irion, 56, of Gowanda was taken into custody March 8 and charged with third-degree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance. After what was called a “lengthy investigation,” Irion was found to have allegedly sold a controlled substance numerous times during the investigation. Irion was arraigned in the Persia Town Court and taken to Cattaraugus County Jail in lieu of $5,000 bail.

Jesse James McIntyre, 20, of Cherry Creek was charged with unlawful possession of marijuana on March 8. Reports of a suspicious vehicle in a parking lot on Jamestown Street were called in and when units were sent to investigate, a strong odor of marijuana was discovered. McIntyre, who was operating the vehicle at the time, was allegedly found to be in possession of 15 grams of marijuana. He was released with an appearance ticket, returnable to Persia Town Court.

John T. Irwin, 21, of Gowanda was charged with criminal mischief, leaving the scene of a property damage accident and driving while intoxicated on March 15. Patrol responded to a report of criminal mischief at a resident on Palmer Street, where it was allegedly found that Irwin intentionally damaged a door. Irwin then struck a mailbox and left the scene. According to reports, when Irwin was located, he showed signs in inebriation and then failed several sobriety tests. His blood alcohol content was allegedly .15 – nearly twice the legal limit. Irwin was arraigned in Persia Town Court and released. He will return to answer for himself at a later date.

Nicholas R. Lone, 31, of Perrysburg was charged with disorderly conduct on March 15. Police responded to reports from the Shop & Save parking lot on Buffalo Street of an intoxicated male causing a disturbance and threatening the patrons of the store. According to reports, when patrol units arrived it was found that Lone was extremely intoxicated; then became belligerent and aggressive toward responding officers. He was taken into custody, arraigned in the Collins Town Court and remanded to the Erie County Holding Center in lieu of $500 bail.

Ricky W. Barber, 60, of Olean was arrested on March 17 on a warrant for his arrest that had been out for two years. Barber was located in Olean by Olean Police. The warrant was issued in 2014 after Barber was charged with disorderly conduct in a Cattaraugus County Shop & Save after allegedly stealing beer and causing a disturbance. Barber then failed to appear in either Persia Town Court or Collins Town Court. On March 17, Barber was found and turned over to Gowanda Police and arrested on these warrants. He was then arraigned in the Collins Town Court and remanded to the Erie County Holding Center in lieu of $1,000 bail.

Cattaraugus County Sheriff’s Office

LITTLE VALLEY – Jeremy J. Steves, 35, of Gowanda was taken into custody March 19 at 9 p.m. on a bench warrant issued in Warren County, Pa. According to reports, Steves was arraigned as a fugitive of justice in Salamanca Town Court and taken to Cattaraugus County Jail. He will then be transferred to Pennsylvania.

SINCLAIRVILLE – Scott Mecca, 41, of Cheektowaga was charged Thursday with driving while ability impaired by drugs after State Police responded to a report of a property damage accident in a work zone on Route 60.

Mecca was subsequently placed under arrest after allegedly failing multiple roadside tests. He was transported to the State Police barracks in Fredonia where he was evaluated by a drug recognition expert and later processed. Mecca was issued tickets and released prior to being determined at fault in the three-vehicle accident.

Chautauqua County Sheriff’s Office

POLAND – Gregory I. Hall, 53, of North East, Pa. was taken into custody after being pulled over on Route 394 in the town of Poland on Saturday.

Hall was pulled over for failure to keep right. At the traffic stop, it was allegedly discovered that Hall was intoxicated, and was charged with driving while intoxicated and DWI with a blood alcohol content of .08 percent or higher, as well.

He was later released and is scheduled to appear in Poland Town Court next month to answer the charges.

PANAMA – Jason A. Earle, 19, of Raspas Hill Road in Panama was taken into custody and charged with second-degree burglary, second-degree criminal mischief and third-degree grand larceny on March 3.

Deputies responded to a residence in the town of Clymer for a past-tense burglary involving a stolen four-wheeler. Deputies recovered the stolen property and found that it had been heavily damaged.

After further investigation, it was alleged that Earle had unlawfully entered the home and stole the four-wheeler. A warrant was issued on a later date, and Earle was placed into custody without incident.

Earle was arraigned in Clymer Town Court and remanded to the County Jail without bail, until a recommendation has been made by the District Attorney’s Office.

ELLERY – Tyler L. McMaster, 42, of Bemus Point was taken into custody Wednesday shortly before 11 p.m. after deputies stopped his vehicle for a traffic violation on Dutch Hollow Road.

According to reports, his passenger was Tammie L. Yonkers, 43, of Lakewood.

Allegedly, during the interview, Yonkers repeatedly provided deputies with a false name and date of birth before they were able to establish her true identity.

Deputies also discovered that a valid order of protection was in place between McMaster and Yonkers.

McMaster’s charges include second-degree criminal contempt and Yonkers was charged with false personation.

They will answer for themselves – separately – in Ellery Town Court.

HANOVER – Aaron L. Green, 31, of Silver Creek was charged with felony driving while intoxicated, Leandra’s Law; felony DWI, previous conviction (within past 10 years); DWI per see, having .08 percent or higher blood alcohol content; second-degree aggravated unlicensed operator; and inadequate headlamps after deputies stopped his vehicle on Angell Road Wednesday at about 2 a.m. According to reports, Green had committed a traffic violation. Upon investigation, deputies allegedly found Green to be intoxicated, with two passengers under the age of 16 in his car – his driving privileges had also been suspended. Green was taken into custody and sent to the Chautauqua County Jail.

FALCONER – Ashley R. Lee, 25, of Falconer was taken into custody and charged with fourth-degree grand larceny and misuse of food stamps (over $1,000), both felonies related to welfare fraud on Wednesday at about 9 a.m. It is alleged that Lee applied for and started receiving SNAP/food stamp benefits at the beginning of May 2015. Later that same month, Lee’s husband started working and receiving income. Lee herself began working in June 2015 and never reported her income or the income of her husband. Lee received SNAP benefits through October 2015 when she did not recertify her case. As a result of unreported income, Lee received $2,044. She was issued appearance for Jamestown City Court. Instances of suspected welfare fraud may be reported by calling the hotline at 1-800-388-5365.

Steven A. Glenn, 30, of Fredonia was charged with third-degree aggravated unlicensed operation of a motor vehicle on March 15.

Jalen T. Faso, 16, of Irving was charged with second-degree harassment on March 16.

Jennifer Collins, 33, of Naples, Florida, was charged with speed in zone, third-degree aggravated unlicensed operation of a motor vehicle and driving with expired insurance on March 17.

J.E. Johnston, 20, of Grand Island was charged with speed in zone and driving without insurance on March 17.

Keith Grzegorzewski, 30, of Portland had a warrant out for his arrest when he was charged with and held for second-degree assault on March 18.

Brett J. Steffen, 33, of Bemus Point was charged with speed in zone and third-degree aggravated unlicensed operation of a motor vehicle on March 18.

Silver Creek man charged with possessing meth

OBSERVER?Staff Report

A Silver Creek man was taken into police custody Tuesday morning after a traffic stop on Brigham Road at Willowbrook Avenue in the city of Dunkirk resulted in the seizure of a methamphetamine pipe and a quantity of methamphetamine.

The incident began just after midnight when a Dunkirk Police patrol officer stopped a vehicle after the driver failed to signal properly for a turn. The driver of the vehicle was identified as Mark R. Massey, 28, of Silver Creek. During the stop officers spotted used drug packaging materials in the vehicle. Further investigation revealed Massey to be in possession of a methamphetamine smoking pipe and a small quantity of methamphetamine.

Massey was charged with seventh-degree criminal possession of a controlled substance in addition to the traffic violation. He was locked up in the city jail in lieu of bail.

Police investigating Jamestown stabbing

JAMESTOWN – Jamestown police are investigating a reported stabbing in the city Tuesday that left one victim hospitalized.

According to Captain Robert F. Samuelson, division commander of the Jamestown Police Department, the stabbing occurred at the Parkview apartments located at 401 W. Fourth St. shortly before 6:30 p.m.

Police have identified a suspect and are searching for a gray Dodge Caravan linked to the incident.

The victim sustained non-life-threatening injuries and was treated at WCA Hospital, Samuelson said.

KIANTONE – Jeremy M. Anthony, 37, of Jamestown was charged with several offenses Sunday after deputies responded to the Kwik Fill on Route 60 at about quarter to 8 p.m. for a vehicle complaint and a wellbeing check. Upon arrival, deputies located the vehicle in question and spoke with the operator, Anthony, who was allegedly intoxicated. After a short investigation he was taken into custody, and a records check of his driving privileges reportedly revealed two prior DWI convictions within the previous 10 years, making this arrest a class D felony. The records check also allegedly revealed Anthony’s driving privileges had been revoked for previous alcohol-related offenses. He was charged with felony driving while intoxicated, aggravated DWI (BAC .18% or greater), first-degree felony aggravated unlicensed operation and unlicensed operator. Anthony was arraigned in Kiantone Town Court and taken to Chautauqua County Jail in lieu of $3,000 bail.

Alguire, 54, of Silver Creek was charged with multiple offenses after his vehicle was stopped on Hanover Road Tuesday shortly before 1 a.m. According to reports, deputies saw him commit several traffic violations. The operator identified himself as Alguire, and deputies allegedly found he was intoxicated while operating the vehicle. Alguire was taken into custody and charged with driving while intoxicated; DWI per se, having .08% or higher blood alcohol content; failure to keep right; and moving from lane unsafely. Alguire was processed and released with citations, directing him to appear in Hanover Town Court.

HANOVER – Timothy W. Eisaman, 27, of Jamestown was charged Sunday with driving while intoxicated, DWI per se and following too closely after deputies responded to a two-vehicle property damage accident on Routes 5 and 20.

Deputies made contact at the scene with Eisaman, who was operating one of the vehicles involved. After an investigation, Eisaman was taken into custody and charged. He was later released with traffic citations and is scheduled to appear in Hanover Town Court on a later date.

NORTH HARMONY – Tyler E. Sutton, 29, of Tidioute Hill, Pa., was charged with several offenses after deputies stopped his vehicle on Panama Steadman Road March 5 at about 7:30 p.m. According to reports, Sutton committed several traffic infractions, and after an investigation, deputies found him to be intoxicated. He was taken into custody and charged with speed in zone, failure to keep right, driving while intoxicated and DWI per se. He was released with tickets and will return t North Harmony Town Court.

Marc R. King, 39, of Erie, Pa., was charged with driving while intoxicated, DWI per se, and insufficient turn signal after deputies stopped his vehicle on Route 20 in Pomfret March 13 at about 3:30 a.m. Allegedly, King was intoxicated and he was taken into custody. He was released with tickets and will answer his charges in Pomfret Town Court.

CASSADAGA – Shawn A. Cavender, 46, of Cassadaga was charged with unlawful possession of marijuana after deputies were called to a Smith Road address for a report of a disorderly person on Thursday at about 5 a.m. Upon arriving and investigating, they found Cavender was the disorderly subject, and that he had a quantity of marijuana in his possession. He was issued an appearance ticket and will answer for himself in Charlotte Town Court.

IRVING – Matthew J. Zanghi, 25, of Irving and a 16-year-old male were questioned after deputies were called to an address to check on the well being of a subject. Zanghi and the teenager were found to be in possession of marijuana, and both were issued tickets for unlawful possession of marijuana. They will answer their charges in Hanover Town Court.

MAYVILLE – Chad A. Klingensmith, 19, of Jamestown was charged Saturday with unlawful possession of marijuana after State Police and Chautauqua County Sheriff Deputies responded to a report of a large party. During their investigation, Klingensmith was allegedly found to be in possession of a bong containing marijuana residue. He was issued an appearance ticket returnable to Chautauqua Town Court and released.

JAMESTOWN – Leslie Nalbone, 56, of Lakewood was charged Saturday with aggravated driving while intoxicated after she was pulled over for reportedly committing a traffic violation. After allegedly failing several field sobriety tests, she was placed under arrest. Nalbone was transported to the State Police barracks in Jamestown where she provided a breath sample of .18 percent. She was then processed, issued tickets returnable to Jamestown City Court, and released.

SHERIDAN – Frederick P. Spruce, 29, of Versailles was charged with multiple offenses after deputies stopped his vehicle on Route 20 March 5 at about 1:30 p.m. Allegedly, Spruce drew attention to himself when he committed several lane violations. After investigating, deputies took him into custody and charged him with driving while intoxicated, DWI per se, failure to keep right and open container of alcohol in a motor vehicle. He will answer for himself in Sheridan Town Court.

ASHVILLE – On Feb. 24 at about 8:30 a.m., a 16-year-old male entered a classroom located in E Building at the Hewes Educational Center and approached another student. The 16-year-old male punched the other individual in the face with a closed fist and was advised by staff to leave. After he left there were no further incidents. Due to his actions, the Chautauqua County Sheriff’s Office was contacted and the male was issued an appearance ticket for disorderly conduct. He will answer for his actions in North Harmony Town Court.

CLYMER – Callie A. Fuller, 23, of Panama was charged with breaking multiple laws after deputies stopped her vehicle on route 76 Tuesday shortly before 1 a.m. According to reports, Fuller was found to be operating the vehicle while impaired by drugs. Fuller was taken into custody and charged with driving while ability impaired by drugs, unlawful possession of marijuana, speed over 55 miles per hour, failure to keep right, moving from a lane unsafely and unlicensed operation of a motor vehicle. She will answer for herself in Clymer Town Court.

BROCTON – Grant S. Courson, 55, of Cassadaga was taken into custody March 12 just after midnight. According to reports, deputies observed a vehicle not signal a turn onto Route 20, and stopped the vehicle. After identifying Courson as the operator, deputies allegedly determined that he was intoxicated. His charges include driving while intoxicated, DWI per se and failure to signal a turn. He was released with tickets and will answer for himself in Brocton Village Court.

SILVER CREEK – Nickolas J. Coggins, 17, of Silver Creek was charged with petit larceny and trespassing based on an incident that happened in August. After a lengthy investigating, deputies allegedly discovered that Coggins had trespassed on a residential property, taken a number of automobile batteries and sold them for scrap money. He was released with tickets and will answer for his actions in Hanover Town Court.

MAYVILLE – Alexandria A. Earls, 23, of Mayville was charged with several offenses after deputies stopped her vehicle Thursday shortly before 1 a.m. on Lakeview Avenue. Allegedly, deputies discovered that she was intoxicated. She was taken into custody and charged with speed in zone, driving while intoxicated, and aggravated DWI per se. She will answer for herself in Chautauqua Town Court.

Marc R. King, 39, of Erie, Pennsylvania was taken into custody Sunday at about 3:23 a.m. after deputies stopped his vehicle on Route 20 in the town of Pomfret for alleged traffic infractions. Reports say that upon investigation, it was discovered that he was intoxicated. His charges include insufficient turn signal, driving while intoxicated, and DWI per se. He will answer for himself in Pomfret Town Court.

Gowanda Police

Kenneth L. Alexander, 44, of Gowanda was charged with unsafe start and third-degree unlicensed operation after patrol stopped his vehicle March 12 shortly after 9 p.m. on Buffalo Street. Allegedly, Alexander skidded into oncoming traffic then accelerated, causing the vehicle to slide sideways. A DMV computer check revealed that Alexander’s license had been suspended in December for failure to pay driver’s responsibility. He was released with tickets and will answer for himself in Collins Town Court.

Darren Warrior, 31, of Gowanda was charged with third-degree assault February 14 at about 10 p.m. after patrol responded to a report of assault at a Water Street business. Allegedly, Warrior had punched and head-butted an individual, causing facial injuries. The victim was taken to Lake Shore Hospital by Gowanda Ambulance Service. Warrior was taken into custody and arraigned in Persia Town Court; he will return to answer the charge at a later date.

Andrew C. Mohawk, 33, of Gowanda was charged with several offenses on February 17. According to reports, patrol responded to reports of a burglary on Walnut Street on May 16, 2014 at about 5 a.m.; the female victim said Mohawk had broken into her home, intentionally damaged a large television, and put his hands around her throat and choked her. Mohawk could not be located at that time, and a warrant for his arrest was requested and received from Persia Town Court. On Feb. 17, Cattaraugus Nation Marshalls encountered Mohawk, took him into custody and turned him over to Gowanda PD. His charges include third-degree burglary, criminal mischief, criminal obstruction of breathing and second-degree criminal trespassing. He was arraigned in Persia Town Court and remanded to jail in lieu of $5,000 bail.

On February 18 at about 11 a.m., patrol responded with EMS to a village address for the report of an unresponsive, unconscious victim of a drug overdose. Gowanda Ambulance Service administered three doses of Narcan, after which the subject became conscious and responsive. The person was then transported to Lake Shore Hospital by Gowanda Ambulance Service.

Kelly C. Mallaber, 24, of Gowanda was taken into custody on a warrant February 26 shortly after 8 p.m. According to reports, Mallaber had been arrested for petit larceny by Town of Hamburg Police, and had failed to appear for her court date; hence, a warrant was issued for her arrest by the Hamburg Town Court. Gowanda Police located Mallaber on Jamestown Street on February 26, took her into custody, and turned her over to Hamburg Police for processing.

Driver hits bicyclist in Dunkirk

No one was seriously injured in a car-bicycle accident March 8, according to Dunkirk Police.

Eugene L. Hilliker, 81, of Dunkirk, was at the intersection of West Second Street and Park Avenue when he struck Hector Cruz, 69, of Dunkirk, who was on his bike. Hilliker claimed he came to a complete stop at the intersection.

However, Cruz and two eye witnesses said Hilliker rolled through the intersection at 3 to 5 miles per hour while Cruz was attempting to cross the street on his bike. Cruz had the right of way, and attempted to cross at the crosswalk, according to police.

Cruz signed off at medical attention at the scene and took personal transportation to Brooks Memorial Hospital after complaining of lower back pain, though he had no visible injuries. Hilliker was driven from the scene by another person. He and his vehicle obtained no visible injuries or damage.

ANGOLA – on Tuesday, the Town of Evans Police Narcotics Unit, assisted by the Town of Hamburg Police Narcotics Unit, executed a search warrant at 55 Lake Street, lower apartment, in the village of Angola.

Upon executing the warrant, officers located numerous types of narcotics in the residence. Michael J. Penvose, 36, and Laura L. Park, 27, were taken into custody. The two were each charged with fourth-degree criminal possession of a controlled substance, a Class C felony; fifth-degree criminal possession of a controlled substance, a Class D felony; criminal use of drug paraphernalia, a Class A misdemeanor; five counts of seventh-degree criminal possession of a controlled substance, Class A misdemeanors; and one count of unlawful possession of marijuana, a violation.

The possession charges relate to various drugs located in the residence, including methamphetamine, cocaine and pills.

The two were arraigned by Evans Justice Dennis Glascott and remanded to the Erie County Holding Center. Bail was set for Park, but no bail was set for Penvose.

IRVING – A Chautauqua County Sheriff’s Office deputy received medical treatment after being bitten by a woman Wednesday.

According to a report, around 8 a.m. police were escorting a woman to Lake Shore Hospital for an evaluation. She become combative, was restrained and in the process bit an officer’s hand.

The 22-year-old woman, whose name was not released, was charged with resisting arrest and assaulting a police officer. She was sent to the county jail in lieu of $10,000 cash/$20,000 property bond bail.

The officer was treated for the hand injury and released.

BRANT – Chelse Wilcox, 31, of Hanover was charged with unlicensed operation of a vehicle, speeding and three counts of criminal possession of a controlled substance on Tuesday shortly before 10 a.m.

Deputies allegedly noticed a vehicle speeding on Milestrip Road, and upon stopping the vehicle and investigating, they discovered Wilcox, the driver, was in possession of numerous morphine and hyrocodone pills and a quantity of white powder. She was taken to the Erie County Holding Center in lieu of $500 bail.

WESTFIELD – According to police reports, an accident occurred Tuesday at about 1:36 p.m. between a vehicle and a bicycle at the intersection of Route 20 and South Portage Street. Allegedly, 48-year-old Lucinda Gelsimino was driving her vehicle on Route 20 and attempted to turn onto South Portage Street; at the same time, 61-year-old Victor Catalano Rivera was riding his bicycle and entered the crosswalk, and they collided. Rivera complained of knee and shoulder pain, and was transported to Westfield Memorial Hospital by the Westfield Fire Department’s ambulance for evaluation.

ASHVILLE – Jessy J. Gleason, 25, of Jamestown was transported to WCA Hospital by Panama Fire Rescue Tuesday shortly before 4 p.m. following a motor vehicle accident on Randolph Road. Deputies were called to the scene after Gleason, the driver, crashed his vehicle and sustained non-life-threatening injuries. Gleason was ticketed for third-degree aggravated unlicensed operation and will answer for himself in North Harmony Town Court.

ASHVILLE – A 16-year-old male allegedly caused a disturbance at the Hewes Educational Center Jan. 13 around 9 a.m. when a counselor approached him for straying from a designated student area. The teenager then reportedly used vulgar language to verbally abuse the counselor, causing a disturbance. The Chautauqua County Sheriff’s Office was called to the scene, where the teenager was served with an appearance ticket for disorderly conduct. He will appear in North Harmony Town Court to answer for his actions.

JAMESTOWN – Mary Margret Simpson, 23, of Bemus Point was charged on March 9 with operating while license revoked/suspended after she was stopped because a license plate reader indicated her registration was suspended. HANOVER – Jeffrey T. Jamison, 49, of Irving was charged on March 13 with aggravated driving while intoxicated, DWI, unlicensed operator and speed in zone after Deputies stopped a vehicle on routes 5 and 20 after reportedly observing traffic violations.

After an investigation, Jamison was allegedly found to be operating his vehicle in an intoxicated state. Jamison was taken into custody and charged. He was later released with tickets to appear in Hanover Town Court at a later date.

Gowanda man facing drug charges

GOWANDA – A 56-year-old village man is facing charges of third-degree criminal possession of a controlled substance with intent to sell and criminal sale of a controlled substance.

Members of the Southern Tier Regional Drug Task force say Reginald Irion of 47 West Hill St., Apartment 4, was charged after a lengthy investigation in the village by the Olean office of the task force, which comprises the Cattaraugus County Sheriff’s Department, New York State Police, Gowanda and Salamanca police and the Allegany County Sheriff’s Department.

Irion was arraigned in Persia Town Court and was transported to Cattaraugus County Jail. Bail was set at $5,000.

Ohio motorist strikes sheriff’s patrol vehicle, charged after chase

ELLINGTON – A Uniontown, Ohio man is facing more than a half-dozen charges after leading Chautauqua County Sheriff’s deputies on a lengthy pursuit, which included a crash into a patrol vehicle early Friday.

Deputies report the pursuit went through several roads in the town and began due to the suspect driver not complying with a traffic stop stemming from an investigation into a suspicious situation.

The driver was identified as Jay E. Head, 39.

During the course of the vehicle pursuit, Head allegedly struck a Chautauqua County sheriff patrol vehicle, causing substantial damage.

After a 10-minute pursuit, his vehicle was stopped and he was taken into custody without further incident around 5:40 a.m.

No injuries were sustained by any of the involved officers.

Head sustained a minor laceration to his arm and was treated by Alstar EMS.

He was charged with second-degree criminal mischief, second-degree reckless endangerment, driving while under the influence of drugs, unlicensed operator, failure to comply with a lawful order, reckless driving and numerous other traffic infractions.

He was later arraigned in court and remanded to the Chautauqua County Jail on the charges.

School kids evacuated, no one injured in bus crash

A small bus accident resulted in the evacuation of 26 children.

During the dismissal of an early school day, a school bus leaving Fredonia Central School at 11:06 a.m. and attempted to turn on to East Main Street, but accidentally clipped the bumper of an east-bound vehicle, according to Fredonia School Business Administrator John Forbes. Whether it was due to a too-wide turn or to the driver not stopping in time is unknown.

The bus was evacuated, students were filed onto another school bus and parents were called to explain the situation.

Fredonia Fire Department was dispatched to the scene, but no one was injured, and there was only minor damage to both vehicles.

No one in either vehicle has been charged at this time.

Pedestrian OK after hit by vehicle

OBSERVER Staff Report

The Fredonia Police Department is investigating an accident involving a pedestrian.

According to police, around 11:30 a.m. Friday a pedestrian was in the area of Church and Day streets in the village, when the individual was struck by a vehicle. The person declined medical attention. There was minor damage to the vehicle.

No names were released and no charges have been placed at this time.

This is the second car/pedestrian accident occurred within a two-week span in the area.

Concord man pleads guilty for shooting children with BB gun

OBSERVER Staff Report

CONCORD – Acting Erie County District Attorney, Michael J. Flaherty, Jr., announced that 29-year-old Steven D. Scroger has pleaded guilty as charged to two counts of second-degree assault before the Honorable John L. Michalski. The defendant pleaded to the highest sustainable charges for which he could have been convicted had he gone to trial.

On Feb. 16, the defendant shot his fiance’s children, who were 6 and 4 years old, multiple times with a BB gun on their legs, arm, and torso. Several days later, the biological father of the children noticed markings on their body when the children were brought to his home. Both children were thereafter brought to the hospital.

Acting DA Flaherty commends Detectives Shaun Hediger, John Graham, Matthew Noecker, and Gregory McCarthy of the Erie County Sheriff’s Office for their thorough investigation.

Scroger was remanded into custody and will be sentenced on April 27 at 9:30 a.m. by Judge Michalski for these crimes, where he faces up to 14 years in state prison.

The case was successfully prosecuted by Assistant District Attorney Jeremy V. Murray.

  • ELLINGTON – An unnamed male operator from Uniontown, Ohio is being investigated in the town of Ellington.

A long way from home, the unnamed operator was reported to the Ellington sheriff’s when seen driving what was described as a “suspicious vehicle.” The deputies located the vehicle and tried to conduct a traffic stop when they observed a violation. When the deputy approached the stopped vehicle, the vehicle fled from the scene. There was then a car crawl (as it was a slow-speed pursuit) for approximately ten minutes.

During this time, the vehicle stopped twice, then proceeded to flee, thus failing to comply with direct orders from an officer.

The vehicle was eventually stopped on Waterboro Hill and the driver was taken into custody. Shortly after, he was transported to WCA for a mental health evaluation.

Assisting at the scene were Cattaraugus County Sheriff Department, New York State Police, Ellington Rescue & Alstar ambulance.

The name of the defendant will be released once the investigation is complete and charges are named.

  • SINCLAIRVILLE – A local male was found at a traffic stop to be unlawfully possessing marijuana.

Jamie A. Goodwill, 28, of Sinclairville was stopped on Route 30 yesterday when seen unsafely changing lanes. During this traffic stop, a short investigation revealed that Goodwill was in possession of a small amount of marijuana.

Goodwill was charged with moving from a lane unsafely and for unlawful possession of marijuana. He was released with traffic and appearance tickets and will appear in Town of Sherman Court at a later date.

He then continued to drive and, when attempting to turn left onto Day Street, struck the Day and Lambert sign as well. Both signs were bent over, then back, by Kaiser. He was charged with destroying village property. Both signs need to be repaired.

According to reports, Jemison drew the deputies’ attention when she failed to stop at a stop sign. Upon investigation, it was determined that she was intoxicated. Her charges include speeding, failure to stop at a stop sign, driving while intoxicated, and operating a vehicle with a blood alcohol content of .08 percent or more.

She will answer for herself in Perrysburg Town Court.

SHERMAN – Ronald A. Lutgen Jr., 23, of Bemus Point was charged Saturday with driving while intoxicated per se and DWI common law after Sheriff’s deputies received a call that one vehicle had struck another vehicle and then left the scene on Main Street.

After a brief investigation, it was found that the passenger in the suspect vehicle Lutgen Jr., had allegedly left the scene in his own vehicle and returned shortly after.

Lutgen was reportedly found to be in an intoxicated state while operating the vehicle.

He was taken into custody and will return to Sherman Town Court at a later date.

CHAUTAUQUA – Randy Stufflebeam, 57, was charged Saturday with consumption of alcohol in a motor vehicle, driving while intoxicated per se, operating in violation of restrictions, second-degree aggravated unlicensed operation and operating without insurance after Sheriff Deputies and Hartfield Fire Department responded to 6088 Route 430 for a report of a subject unresponsive in a parked vehicle.

Upon arrival it was determined that Stufflebeam was intoxicated and further investigation led to his arrest for the above charges.

He was arraigned in Chautauqua Town Court and committed to Chautauqua County Jail with bail set at $500 cash or $1,000 property.

BROCTON – Four young adults face drug and/or alcohol charges after a traffic stop for an observed traffic violation on Saturday.

Kristopher M. Degolier, 20, of Fredonia was driving the vehicle when it was pulled over for speed in zone.

Further investigation reportedly found a quantity of marijuana on Degolier and two passengers.

Passengers Kyle A. Roush, 19, of Fredonia and Brittany M. Siragusa, 18, of Brocton, along with Degolier, were charged with unlawful possession of marijuana, while Siragusa was additionally charged with unlawful possession of alcohol.

A third passenger, Jessica L. Small, 19, of Forestville was charged with unlawful possession of alcohol as well.

All four subjects were charged and released with appearance tickets to appear in Brocton Village Court at a later date.

Cattaraugus County Sheriff’s Office

LITTLE VALLEY – Mark A. Frentz, 46, of Little Valley was taken into custody Thursday shortly after 6 p.m. for charges related to drug use.

According to reports, a drug investigation headed up by the Olean Office of the Southern Tier Regional Drug Task Force led law enforcement to Frentz’s Oak Street residence. Allegedly, officers found a sophisticated growing operation in the basement, with heating lamps and reflective wrap surrounding a room full of marijuana plants.

Frentz was charged with unlawfully growing the plant known as cannabis by an unlicensed person, fourth-degree unlawful possession of marijuana and second-degree criminal use of drug paraphernalia.

Frentz will answer charges in Little Valley Town Court on March 23.

The Olean Office of the Southern Tier Regional Drug Task Force comprises the Cattaraugus County Sheriff’s Office, New York State Police, the Gowanda Police Department, the Salamanca Police Department and the Allegany County Sheriff’s Office.

  • RANDOLPH – A registered sex offender from Randolph has been taken into custody for failing to report a change of address.

Brandon Bush, 34, of 102 E. Main St., Randolph, was arrested on a warrant out of Randolph Town Court.

Bush was arraigned in South Valley Court, then sent to the Cattaraugus County Jail in lieu of $250 bail.

FRENCH?CREEK – Richard E. Herrick, 51, of Waterford, Pennsylvania, was stopped in the town of French Creek for allegedly committing a traffic violation.

He was charged with driving while intoxicated after reportedly being found operating the vehicle in an intoxicated state, as well as failure to stop at a stop sign and failure to use a turn signal.

Herrick was issued traffic tickets for French Creek Town Court and will appear back in court at a later date.

CHAUTAUQUA – At about 12:20 a.m. Thursday, deputies responded to a residence for a reported overdose. At this time the Chautauqua Fire Department ambulance and the Mayville Fire Department ambulance were dispatched to the scene. Upon arrival, deputies found an unconscious, unresponsive subject who appeared to have overdosed on controlled substances. Deputies administered Narcan to the subject, who subsequently regained consciousness and was transported to an area hospital by ambulance for further treatment.

HANOVER – Levi A. Pfleuger, 21, of Forestville was charged with driving while ability impaired by drugs on Tuesday at about 10:21 p.m. Allegedly, deputies responded to reports of a vehicle that had gone off the road along Old Main Road. The driver was identified as Pfleuger, who was transported to a hospital for treatment. The investigation showed that he was impaired by drugs. In addition to the DWAI, he was charged with moving from a lane unsafely. He will answer for himself in Hanover Town Court.

Sheriff’s K9 team finds autistic teen

BUFFALO – Erie County Sheriff Timothy B. Howard reports that an Erie County Sheriff’s Office K9 team was called to assist in tracking an autistic teen that fled a vehicle which was stopped on the side of the road.

Deputy Lundberg and his partner Haso were dispatched to Aldrich Road in the Town of Collins Sunday morning where a vehicle was forced to pull over to the side of the road. While the vehicle was stopped, the teen exited and ran into the adjacent woods.

Deputy Lundberg and Haso began their track at 10:58 a.m. and at 11:04 a.m. the team located the teen and returned the individual to family members. The teen was safe and in good health.

Deputy Lundberg and Haso graduated from canine handler training on Feb. 5 and have achieved certification for tracking and narcotics detection.

Deputy Lundberg is a two-year veteran of law enforcement and has been with the Erie County Sheriff’s Office since August 2014. Haso is an 18-month-old German shepherd and officially joined the sheriff’s office in December 2015.

Kenneth M. Schunk, 25, of Dunkirk was charged on Feb. 22 with seventh-degree criminal possession of a control substance after being stopped for failure to signal before turning.

Adrian Rivera-Velez, 37, of Dunkirk was charged on Feb. 23 with possession of a hypodermic needle, disorderly conduct and driving without a required ignition interlock.

Richard E. Weber, 26, of Dunkirk was charged on Feb. 24 with second-degree harassment.

Theresa Will, 34, of Forestville was charged on Feb. 24 with second-degree harassment.

Vincent L. Perez, 60, a fugitive from justice from Colorado was captured in Dunkirk on Feb. 24 and sent to Chautauqua County jail for 30 days while awaiting county court action.

James A. Roberto, 33, of Silver Creek was charged on Feb. 24 with second-degree aggravated unlicensed operation, driving without an interlock restriction, and no plate lamps.

Travis Maxwell Jr., 18, of Dunkirk was charged on Feb. 24 with second-degree burglary and third-degree arson.

Margaret Borello, 47, of Forestville was charged on Feb. 25 with second-degree harassment.

Shaunquilla Danis, 25, of Dunkirk was charged on Feb. 25 with second-degree assault.

Daniel Ayala-Valentia, 26, of Dunkirk was charged on Feb. 26 with aggravated unlicensed operation of a motor vehicle, failure to stop at a stop sign, and driving with a child who was not in a child seat.

Brian Christina, 47, of Fredonia was charged on Feb. 26 with driving with improper plates, driving with no headlights, unlicensed operation of a vehicle, driving an unregistered motor vehicle, and driving with no car insurance. Adam R. Jessie, 26, of Dunkirk was charged on Feb. 27 with criminal possession of a hypodermic instrument and petit larceny.

Michael P. McNiff Jr. of Dunkirk was charged on Feb. 27 with 7th degree criminal possession of a controlled substance.

Jonathan R. Rodriguez, 29, of Dunkirk was charged on Feb. 28 with second-degree harassment.

Joshua Berakah, 20, of Dunkirk was traveling south on Central Avenue on Feb. 28 when he reportedly fell asleep and struck a pole. The pole received extensive damage, and Berakah was taken to Brooks Memorial Hospital for injuries.

Kelsey C. Sullivan, 20, of Dunkirk was charged on Feb. 23 with and issued three appearance tickets for open container, littering and underage possession of alcohol.

Lauren H. Augusty-niak, 20, of Niagara Falls was charged on Feb. 23 with possession of marijuana after being stopped for speeding. She was issued an appearance ticket and a traffic ticket.

Richelle D. Rose, 25, of Dunkirk was issued two traffic tickets on Feb. 25 after being charged with driving through a red light and third-degree aggravated unlicenced operation of a motor vehicle.

Thomas M. Vetrano, 20, of Wappingers was charged on Feb. 26 with violating the sewer ordinance and possession of a fake license. He was released on $100 bail.

Joshua M. Warren, 24, of Fredonia was charged on Feb. 27 with failure to stop at a red light, failure to yield, driving while intoxicated, and aggravated DWI. He was released and expected to appear on 3/2/16.

Christine E. Fenton, 49, of Fredonia was issued two traffic tickets for and charged with DWI per se and aggravated DWI after, on Feb. 27, she attempted to back out of a driveway, backed into a yard-dividing fence across the street, pulled forward, attempted to back out again, slid and backed into a tree.

Chautauqua County Sheriff’s Office

CHAUTAUQUA – Jennifer R. McConnell, 46, of Mayville was charged with false personation and resisting arrest Friday around 3 a.m. after deputies investigated an incident on Elmwood Road.

Allegedly, during the investigation, McConnell provided a false name and date of birth multiple times, after she was warned that doing so is illegal. According to reports, she also physically resisted arrest. She was arraigned in Ellery Town Court due to the judge in the town of Chautauqua being unavailable. She was remanded to the Chautauqua County Jail on $750 cash bail.

BROCTON – Sebas-tian Hernandez Rojas, 20, of Brocton was charged with third-degree assault after deputies investigated a physical altercation that allegedly took place at Hernandez Rojas’ home.

According to reports, he punched and kicked another individual, causing injury. Hernandez Rojas was arraigned in Brocton Village Court and taken to Chautauqua County Jail with bail set at $3,000 cash or $6,000 property bond. The victim refused treatment for the injuries sustained.
