City sues for marina cleanup compensation

The city of Dunkirk recently filed a lawsuit against MC Docks LLC, Ryan Marine Services, Donald J. Ryan, Richard W. Ryan, Huntington Bancshares Inc., Lake City Ice & Fuel, Chadwick Bay Marina Holdings Inc., Chadwick Bay Marina LLC and Chadwick Bay Marina LP in regards to a petroleum discharge that took place in 2011 at the marina.

Though the property is city owned, the city never installed two unregistered storage tanks buried underground at the site that the Department of Environmental Conservation discovered. Dunkirk paid $131,497 in July 2019 to excavate, remove and clean-up the site and is now looking for indemnification and contribution from the above previous occupants. The city cites that the tanks and their condition was never disclosed to them and thus the other parties are responsible for the costs the city incurred.

“We had to do this,” Mayor Wilfred Rosas stated. “We never received any kind of payment, so now we’re taking it to court.”
